If you believe content distributed through CD Baby infringes on your copyright, you can file a formal takedown notice under the Digital Millennium Copyright Act (DMCA). This process allows rights holders to request the removal of infringing material from distribution.
Before Filing a Takedown Notice
- Account changes: CD Baby can only make changes to an account with the permission of the current account holder. If you know them, please contact them directly to resolve the issue.
- When to file a takedown: If you do not know the account holder, or if they do not own or have not cleared the necessary rights to distribute the content, you may file a formal DMCA takedown request.
- Legal note: You are not required to use an attorney, but CD Baby recommends consulting one. You can also review 17 U.S.C. § 512(c)(3) for full DMCA notice requirements.
